Naungan Law is a legal practice established under the laws of Malaysia, providing advisory and representation services in pension-related matters. Our principal office is located at Level 14, Menara Bangkok Bank, 105 Jalan Ampang, 50450 Kuala Lumpur. We operate in accordance with the Legal Profession Act 1976 and the rules of the Malaysian Bar.

References to "Naungan Law", "we", "us", or "our" in these terms refer to the firm. References to "you" or "client" refer to any individual who engages our services or uses our website.

2. Scope of These Terms

The scope, fee, and conditions of each service are set out in the engagement letter issued to you before work commences. No service is deemed to have begun until an engagement letter has been signed and the initial fee has been received, unless otherwise agreed in writing.

4. Engagement and Commencement

4.1 Enquiries

Submitting an enquiry through our website or contacting us by telephone does not create a solicitor-client relationship. We will review your enquiry and, where appropriate, arrange a consultation to discuss your matter.

4.2 Formal Engagement

A formal engagement begins when you have signed our engagement letter and we have confirmed acceptance of your matter in writing. We reserve the right to decline any matter without providing a reason, subject always to our professional obligations.

4.3 Conflicts of Interest

Prior to accepting any engagement, we conduct a conflict-of-interest check. If a conflict is identified, we will inform you promptly and, where appropriate, suggest alternative arrangements.

5. Fees and Payment

5.1 Fee Structure

Our fees are stated in Malaysian Ringgit (RM) and are set out in the engagement letter. The fees published on our website are indicative and may vary depending on the complexity of your matter.

5.2 Payment Terms

Unless otherwise agreed, payment of the engagement fee is required before work commences. For ongoing or complex matters, interim billing may apply as set out in the engagement letter.

5.3 Additional Disbursements

Out-of-pocket expenses reasonably incurred on your behalf — such as filing fees, courier charges, or third-party professional fees — will be billed separately and are not included in the stated service fee unless explicitly noted.

5.4 Taxes

All fees quoted are exclusive of any applicable taxes, including Sales and Service Tax (SST), which will be added where required by law.

6. Confidentiality

We treat all information shared with us in the course of an engagement as confidential. We will not disclose client information to third parties without your prior written consent, except where required by law, by a court order, or to carry out your instructions (for example, corresponding with the EPF or a relevant government department on your behalf).

Our confidentiality obligations survive the conclusion of any engagement.

7. Client Obligations

To allow us to act effectively on your behalf, you agree to:

We are not liable for any adverse outcome arising from your failure to provide information or documents in a timely manner.

8. Limitation of Liability

Our liability to you in connection with any engagement is limited to the fees paid by you for that specific matter. We are not liable for indirect, consequential, or incidental losses arising from the provision of our services, except where such loss results from our fraud, wilful misconduct, or gross negligence.

Nothing in these terms limits or excludes any liability that cannot be excluded under applicable Malaysian law.

9. Termination

9.1 Termination by You

You may terminate an engagement at any time by providing written notice. Fees for work already completed or disbursements already incurred will remain payable.

9.2 Termination by Us

We may terminate an engagement where you have failed to meet your obligations under these terms or the engagement letter, where a conflict of interest arises, or where required by our professional obligations. We will provide reasonable notice and take steps to minimise any prejudice to your matter.
